Terms & conditions
These terms and conditions (the "Terms") govern your membership with Infinite Gym. Please read them carefully, as they outline your and our legal rights and responsibilities and contain important information regarding our contract with you.
If you have any questions, please don't hesitate to contact us at hello@infinitegym.co.uk before confirming your membership. By completing the sign-up process, you acknowledge and accept these Terms. If you do not agree to these Terms, do not complete the sign-up process or use our services in any way. Your continued use of our gym facilities shows that you've accepted these Terms.
References to "we," "our," or "us" refer to Infinite Gym. References to "you" or "your" refer to the member.
1. ABOUT US
We are Infinite Gym, a functional fitness gym registered in Scotland. Our registered office is Unit A4, Midlothian Innovation Centre, Roslin, EH25 9RE. For any questions regarding your membership, please get in touch with us through our email hello@infinitegym.co.uk.
2. DEFINITIONS
2.1 The following definitions apply to these Terms:
**Gym**: Infinite Gym, where you sign up as a member.
**Direct Debit**: The payment arrangement with your bank to pay your monthly fees through Stripe, our payment processing partner.
**Fixed Member**: A member who commits to a fixed-term membership, either 1 or 12 months.
**Package Member**: A member with a class pass or class pass bundle purchase.
**Fixed Member Period**: Your fixed-term membership duration (1 or 12 months).
**Health Declaration**: The declaration regarding your health and fitness status that you complete during sign-up.
**Member**: Refers to both Package Members and Fixed Members.
**Promotional Code**: Any promotional or introductory discount applied to your membership.
**Rules**: The gym's rules, which are displayed at Infinite Gym and on the Infinite Gym website.
3. JOINING
3.1 You can sign up for membership online with our booking system, WodBoard. Please ensure that all details you provide are accurate and complete.
3.2 During sign-up, you must choose between becoming a Package (Drop-in or Bundle) or a Monthly Member. Your contract with us ("Contract") is formed once you pay for your first package or your first month and apply any applicable Promotional Code.
3.3 You must confirm that you are at least 16 years old and agree to abide by the Rules and Health Declaration. We reserve the right to amend the Rules at any time, with updates posted online and in our Gym.
3.4 After completing the sign-up process, your membership begins immediately unless you choose a specific start date.
3.5 You must ensure that all information provided at sign-up and in your Health Declaration is true and correct. We reserve the right to refuse or cancel your membership if we reasonably believe the information provided is false or incorrect.
4. PAYMENT
4.1 If you are a Package Member, you agree to pay an upfront fee for your chosen package. This does not commit you to any rolling contract.
4.2 If you are a Fixed Member, you agree to pay the first Monthly Fee upfront, followed by a rolling monthly payment for 12 months.
4.3 Promotional Codes must be applied during sign-up. After the promotional period ends, we will charge the standard Monthly Fee throughout your contract.
4.4 We will continue to charge Monthly Fees even if you do not use the gym or if access is restricted, except in emergency closures, where we will provide notice.
4.5 If you received a discount via a Promotional Code, your Monthly Fee will revert to the standard rate once the promotional period ends.
4.6 If payment of any amount due is not made by the due date, you will not be permitted to attend classes or access the gym. For every 24 hours that passes thereafter without payment, access will remain restricted, and a late fee of £5 will be added for each 24-hour period. If the outstanding amount is not settled within 30 days, the debt may be passed to a debt collection agency for recovery.
4.7 We reserve the right to increase membership fees at any time after your Fixed Member Period ends. Any renewal or new membership purchased after the completion of your Fixed Member Period will be charged at the then-current rate, and the previous membership price will no longer apply.
5. GYM CLOSURES AND CLASS CANCELLATION
5.1 If the gym must close for an extended period, we may freeze your membership and payments during the closure.
5.2 The gym reserves the right to cancel classes or open gym without prior notice. Please note that cancellations will not entitle you to any refunds or credits.
5.3 We require a minimum of 12 hours' notice for any class cancellations. If you cancel a class with more than 12 hours' notice, your class credit will be returned to your account. Cancellations made within 12 hours of the scheduled class time are considered late cancellations, and no credit or refund will be issued. This policy allows us to manage class capacity effectively and offer available spots to other members.
6. CANCELLATION PERIOD
6.1 You have the right to cancel your package, one or 12-month membership if you have yet to book or attend a class within 24 hours of signing up without giving a reason. To cancel, contact us via the Infinite Gym Contact Form or hello@infinitegym.co.uk before the 24-hour period ends.
6.2 If you cancel within this period, we will refund your payment, and your gym and class access will end immediately. Your refund can take up to 30 days to be processed.
6.3 After this period, you may only request to cancel your membership under the conditions described in section 7.
7. CONTRACT TERMINATION OR MEMBERSHIP FREEZE
7.1 Contract Termination
After the 24-hour cancellation window, Fixed Members may request early termination under the following conditions:
Relocation: Moving over 50 miles from Infinite Gym, with supporting documentation (e.g., recent utility bill or bank statement).
Early Exit Fee: Members who do not meet the above criteria may still cancel by paying an early termination fee equal to three months’ membership.
All termination requests must be submitted in writing to hello@infinitegym.co.uk.
Once your request has been approved, you will be informed of your final membership payment date. If your request is approved less than 30 days before your next scheduled payment, you will be required to make that payment in addition to the three-month membership termination fee. If making another monthly payment, you will have access for that month only. If providing more than 30 days’ notice, you will only have access during your last payment period. Your termination of membership is not final until your termination payment has been arranged and paid.
Infinite Gym reserves the right to review and deny any request at its discretion.
7.2 Membership Freeze
Fixed Members may request to freeze their membership in the following circumstances:
Medical Grounds
Long-term illness or injury lasting three months or more, supported by a valid medical note.Pregnancy
With an appropriate medical note.
All freeze requests must be submitted in writing to hello@infinitegym.co.uk.
Memberships can be frozen for a maximum period of up to 12 months. At the end of the freeze period, the membership will automatically resume for the remaining duration of the original 12-month fixed term from the point at which it was paused.
Alternatively, at the end of the freeze period, the member may choose to terminate their membership by paying a termination fee equivalent to three months’ membership.
Infinite Gym reserves the right to review and deny any request at its discretion.
7.3 End of Fixed Membership Period
At the end of your Fixed Membership Period, your membership will end automatically unless you choose to renew. To renew, you must purchase a new membership before the end of your Fixed Membership Period. If you do not wish to renew, no action is required, and your access to the gym will end at the conclusion of your Fixed Membership Period.
8. CONTRACT TERMINATION BY US
8.1 We may terminate your membership immediately if you:
- Breach any of the Rules.
- Provide false or outdated information in your Health Declaration.
- Engage in behaviour deemed inappropriate by our staff and coaches.
- Share your membership with others.
8.2 We reserve the right to cancel your membership or deny you access to Infinite Gym at any time, with or without prior notice or explanation.
9. QUERIES, PROBLEMS, OR COMPLAINTS
9.1 For queries about Infinite Gym, contact us via our email at hello@infinitegym.co.uk or speak to the staff at Infinite Gym.
9.2 These Terms do not override or exclude any of your legal rights.
10. LIMITS OF OUR RESPONSIBILITY
We are not responsible for:
- Loss or damage that is not reasonably foreseeable.
- Loss resulting from your misuse of the gym or its equipment.
- Loss due to events beyond our reasonable control.
However, nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any situation where liability cannot be legally excluded.
11. YOUR PERSONAL INFORMATION
11.1 We may collect information about you during sign-up and your use of the gym. This is detailed in our Privacy Policy, which forms part of these Terms.
11.2 For Direct Debit purposes, your information may be processed by our payment provider.
11.3 We do not sell your information, but may share it with select third parties.
12. MEDIA CONSENT AND CCTV NOTICE
By attending classes and using the space at Infinite Gym, you acknowledge and consent to the following:
12.1 Media Capture: Infinite Gym may capture photographs and videos of the gym and its activities, including its members, for promotional and marketing purposes. This may include, but is not limited to, social media, website content, and promotional materials. By using the gym facilities, you grant Infinite Gym permission to use such media in any manner, including but not limited to publication, display, or online sharing, without any further notice or compensation to you.
12.2 CCTV Surveillance: For the safety and security of all members, coaches, and employees, Infinite Gym utilises closed-circuit television (CCTV) surveillance throughout its premises. CCTV footage is monitored and recorded to ensure a safe environment and to help resolve any incidents or disputes that may arise. By entering the gym, you consent to being recorded by these surveillance systems.
13. DATA PROTECTION & GDPR
By visiting our website, you agree to the use of your data entered for membership purposes. We will not share or sell your data to third-party sites.
We use Squarespace to host our website and scheduler, which includes their privacy and GDPR policy.
14. HOLIDAY & GYM CLOSURES
14.1 Infinite Gym reserves the right to close the gym at any time, with or without prior notice, for operational, maintenance, or safety reasons.
14.2 The gym will generally be closed on public holidays. However, we may offer a limited schedule or additional classes during these times at our discretion.
14.3 Membership fees will not be adjusted or refunded due to temporary closures, including for public holidays or unforeseen circumstances.
